Terms of Service

By accessing or using the Hugogen workspace and AI services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

Hugogen provides an artificial intelligence platform and workspace ("Platform"). The Service is provided on an "as is" and "as available" basis without warranties of any kind.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, and without liability to you.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable local, national, or international law or regulation.
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service.
• Use the Service to transmit, or procure the sending of, any advertising or promotional material without our prior written consent.
• Impersonate or attempt to impersonate Hugogen, a Hugogen employee, another user, or any other person or entity.
• Engage in any conduct that, as determined by us, may harm Hugogen or users of the Service.
• Use any robot, spider, or other automatic device, process, or means to access the Service for any unauthorized purpose.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service.
• Use the Service to generate, create, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by Hugogen, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service strictly in accordance with these Terms. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as permitted by these Terms.

You retain ownership of any content, data, or information you submit to the Service ("User Content"). By submitting User Content, you grant Hugogen a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content for the purpose of providing, securing, and improving the Service, including to develop and improve our AI models as described in our Privacy Policy.

By submitting User Content, you acknowledge and agree that Hugogen may use your User Content, and the outputs generated through the Service, to operate, secure, support, and improve the Service and to develop and improve its AI models and systems, as described in the Privacy Policy and subject to any opt-out offered there. This use is a normal and necessary part of providing an AI Service. Any opt-out applies going forward only and does not require Hugogen to delete or retrain models already trained. Aggregated, anonymized, or de-identified data that Hugogen derives from User Content is owned by Hugogen, does not identify you, and is not subject to the restrictions in this section. You are responsible for the User Content you submit and should not submit sensitive personal data or any content you do not have the right to share.

You represent and warrant that: (i) you own or control all rights to your User Content; (ii) your User Content does not violate these Terms or any applicable law; and (iii) your User Content does not infringe on any third-party rights.

We reserve the right to remove or refuse to post any User Content for any reason or no reason. We take no responsibility and assume no liability for any User Content that you or any other user or third party posts or sends over the Service.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. HUGOGEN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

HUGOGEN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE, RELIABLE, OR COMPLETE, OR THAT DEFECTS WILL BE CORRECTED.

THE SERVICE, INCLUDING ANY AI-GENERATED OUTPUTS, IS NOT INTENDED TO PROVIDE PROFESSIONAL ADVICE (LEGAL, FINANCIAL, MEDICAL, OR OTHERWISE). ANY DECISIONS MADE BASED ON THE SERVICE ARE YOUR SOLE RESPONSIBILITY.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HUGOGEN, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of, or inability to access or use, the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.
• Any AI-generated outputs or recommendations provided by the Service.
• Any errors, mistakes, or inaccuracies in the Service.
• Personal injury or property damage resulting from your access to and use of the Service.

IN NO EVENT SHALL HUGOGEN'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID HUGOGEN IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).

You agree to defend, indemnify, and hold harmless Hugogen, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content and any use of the Service's content, services, and products other than as expressly authorized in these Terms.

You acknowledge and agree that:

• AI-generated outputs may contain errors, inaccuracies, or hallucinations.
• The Service may produce biased, incomplete, or inappropriate responses.
• You are solely responsible for verifying any AI-generated content before relying on it.
• The Service should not be used as a substitute for professional judgment or advice.
• AI models may be updated or changed without notice, which may affect output quality or consistency.
• Hugogen makes no guarantees about the accuracy, completeness, or reliability of AI-generated content.

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection, use, and disclosure of your information as described in the Privacy Policy.

As described in the Privacy Policy, data and content you provide may be used to operate, secure, and improve the Service, including to train and improve our AI models, and you may opt out of the use of your content for model training. We may use anonymized or aggregated data for research and development purposes.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms are entered into with PT Evora Vera Teknologi, a limited liability company incorporated under the laws of the Republic of Indonesia that operates Hugogen, and shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall be finally resolved by binding arbitration administered by the Indonesian National Board of Arbitration (Badan Arbitrase Nasional Indonesia, "BANI") in accordance with its rules then in force. The seat of arbitration shall be Jakarta, Indonesia, and the language of the arbitration shall be Indonesian or English. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION.

You agree to comply with all applicable export and re-export control laws and regulations. You represent that you are not located in a country subject to a government embargo or designated as a "terrorist supporting" country, and that you are not listed on any government list of prohibited or restricted parties.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hugogen regarding the Service and supersede all prior agreements and understandings.

Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

Force Majeure: Hugogen shall not be liable for any failure or delay in performance due to causes beyond its reasonable control.

Credits: Paid features are metered in credits. Credits are a prepaid license to use those features. They are not money, carry no cash value, and are non-refundable except where required by law.

Plan credits: The monthly credits included with a paid plan are granted each billing cycle and do not roll over to the next cycle.

Top-up credits: Credits purchased as a one-time top-up are valid for 90 days from the date of purchase. Top-up credits not used within that period expire and are not refundable or restorable.

Promotional credits: Free signup credits and onboarding bonus credits are promotional, have no cash value, and may be changed or withdrawn at any time. We may change credit prices or the credit cost of any feature with notice through the Service.
